What is arbitration?

Arbitration is a way of resolving the problems that come up during a divorce. Divorce can be a long, expensive process – especially if you go to court. Arbitration is a way of keeping your divorce out of court, controlling the costs and working things out amicably. For many couples, it provides a straightforward solution to a complex situation.

You might feel like you’ll never see eye-to-eye with your former partner, or be worried about your children’s future. There’s a lot to think about, like your family home, money, pensions and childcare.  Arbitration gets you together, and helps put you on the same page.

You both choose an arbitrator – an expert who'll guide you. They’ll represent your interests, give you advice and work with your ex-partner's arbitrator as well. Together, you’ll talk about and settle the issues you agree are important. Your agreement becomes a legally binding decision called an ‘award’.

You're in control of the process

Arbitration is a truly flexible option. You'll shape it from the start, by picking your own arbitrator - someone you can rely on to fight your corner (you can't choose a judge at court!). The deadlines, timetable and issues to resolve are completley defined by you and your ex-partner. You'll only need to talk about the important issues.

It's often cheaper and faster than other options

Because arbitration gives you so much choice, it can help you save money on legal fees. It's also generally quicker than going through the court process. Just talking to each other, supported by a legal specialist, can be much more productive.

It protects your privacy

Arbitration is confidential because the courts aren't involved. Everything you agree, or talk about, stays between you, your ex-partner and your solicitors. Your personal life stays personal, and can't be reported on by the media.
