What is arbitration?

Arbitration is a way of resolving the problems that come up during a divorce. Divorce can be a long, expensive process – especially if you go to court. Arbitration is a way of keeping your divorce out of court, controlling the costs and working things out amicably. For many couples, it provides a straightforward solution to a complex situation.

You might feel like you’ll never see eye-to-eye with your former partner, or be worried about your children’s future. There’s a lot to think about, like your family home, money, pensions and childcare.  Arbitration gets you together, and helps put you on the same page.

You both choose an arbitrator – an expert who'll guide you. They’ll represent your interests, give you advice and work with your ex-partner's arbitrator as well. Together, you’ll talk about and settle the issues you agree are important. Your agreement becomes a legally binding decision called an ‘award’.
