Can I make a claim?

What will happen?

The law specifically states that you can claim for compensation if somebody else caused the fatal accident. All claims are made on behalf of dependants, which can include:

  • A wife or husband or former wife or husband
  • A civil partner or former civil partner
  • Anybody living with the person who died as husband or wife or civil partner for at least two years before the accident
  • Any parent or child of the person who died
  • Any brother, sister, aunt, uncle or cousin

What you can claim

If the person who died was your husband, wife, or child under 18, you’re entitled to a statutory bereavement award. This is currently fixed at £12,980 and is paid on top of any compensation. Beyond that, the compensation you can claim might include:

  • The pain and suffering of the person who died
  • Loss of income to the family
  • Childcare costs and household expenses
  • Counselling services
