Expert advice for employers

The right disciplinary policies, and properly trained staff, can help protect your business against risk. If you are considering disciplinary action against an employee – whether it’s for poor performance or breach of company policy – it’s vital that you follow the correct legal procedure. Otherwise, you may expose your business to legal claims.

Tees can support you at every step. We will ensure that you comply with your legal obligations, and follow best practice (including the ACAS code of practice). Our experts can also provide scripts and template letters to send to staff, and legal advice regarding the process to follow throughout a tribunal claim. We’ll also help you define reasonable sanctions.

How we work with you

Tees will guide your business through every stage of the disciplinary process, including:

  • Whether to start disciplinary action against an employee
  • What types of sanction to impose
  • Whether you have grounds for dismissal.

Our employment law team has considerable expertise guiding employers through complex disciplinary issues. So, if you need advice about a disciplinary issue, we have the practical experience to advise you. Call our employment law team on 0800 0131165 for an initial conversation about how we can help.

Manager and HR training

It’s important that any investigation is carried out correctly in order to provide a solid foundation for any disciplinary decision. It can benefit your business to train senior staff in the correct way to handle disciplinary issues.

Tees provides practical training for managers and HR staff. We will train your staff on how to conduct disciplinary investigations properly – and help your business avoid complications and common pitfalls.

Practical solutions for your business

We work with our business clients to minimise risk of a legal claim and find practical solutions, tailored to you. Our experts take the time to sit with you, and really understand your business – and what you need to achieve. Then, we’ll work hard to find a legal solution that's right for your needs. Unlike many law firms, we won’t simply quote your legal obligations. We find creative, practical solutions that really work for our clients.

Recent work

We recently acted for a client who had not realised they could contact their employee’s GP without their employee’s consent to ask whether or not that employee was fit to attend a disciplinary. We advised our client of this, and it transpired that the employee was fit to attend. Tees progressed the disciplinary on that basis; reducing the delay, and cost, to our client.

Our costs

We deliver costs transparently, and we always discuss legal costs at the outset. We can agree our level of involvement to be commensurate with your budget, and we can be involved as much, or as little, as your business requires. We can provide ad hoc advice as required, and prepare guides, scripts and template letters for you to use.

What to do next

If your relationship with your employee’s breaks down, we can help you get it back on track – and take the appropriate legal steps. Call us now for a confidential discussion about how we can help.
